Another Trespassing Case
The Real Estate Council of Ontario looked at another “no trespassing” case this Spring.
The Buyers’ representative booked an appointment, didn’t show up, and released the lockbox code to his clients directly. They entered and used the Seller’s measuring tape which they located inside the premises to conduct some measurements. The Seller came home and found them.
It is not clear whether they knew that they were trespassing.
This particular Disciplinary Panel imposed a $3,000.00 fine on the Buyers’ representative in March 2016.
Another Panel has imposed a $3,500.00 fine on another registrant for a similar offence. The agent’s actions were considered a breach of the following Sections 3 (fairness and honesty), 5 (competent service), 38 (unethical practice) and 39 (unprofessional conduct) of the Code of Ethics.
