Do You Know the Difference between the Quality and the Quantity of Title?

Well, if you’re a professional in the business, a lawyer, surveyor or real estate agent, or even a seller, buyer or mortgagee, then you should.

 

The distinction was just made clear by the Ontario Court of Appeal, and there are some serious implications.

 

The matter of the guarantee under the Land Titles Act, title insurance and the role of the survey were reviewed carefully by the Court.

 

Let’s discuss this new case at my upcoming seminar on “Surveys, Boundaries and Adverse Possession” on 3 May 2013.

 

There are some important issues:

 

  • Is the guarantee under the Land Titles Assurance Fund sufficient?
  • Should you obtain Title insurance?
  • Do you need a survey?
