The course on the “The Law of Agency ” will run on 3 November 2014, from 9:30 am to 12:30 pm at 186 Robert Speck Parkway, Mississauga, Ontario L4Z 3G1.
Understanding the law of agency is an important and underlying obligation of anyone who offers “agency services”. There have been a lot of changes over the past two decades. Have you kept up with the changes? Do you know what they are?
Starting with a quick review of the basic fiduciary duties to the current duties imposed by the Supreme Court of Canada, you will understand and appreciate your fundamental responsibilities. What is the modern rule?
How is agency created? You must be concerned when your actions speak louder than words. Have you created an agency relationship? Was is intended, or might it have occurred by mistake, oversight or error on your part? How does agency get created by estoppel, necessity and ratification?
What is your liability in situations where you are acting for unknown, undisclosed or not yet incorporated parties?
What about multiple representation? How should you handle that if you wish to decrease your risk of liability?
How do you properly explain the distinction between clients and customers? What’s the difference? How do you properly document the relationships?
And, what is your relationship to the non-titled spouse?
